Caravan Storage Terms and Conditions

1. The caravan must be the sole property of the storage customer either outright or subject to a purchase agreement with a Bank or Finance House. Such proof of ownership will be provided to Bow Hill Farm when requested

2. The rental fee is payable monthly in advance. A storage bay will not be let for less than 12 months. Bow Hill Farm has the right to alter the rental and/or terms of business by giving due notice to the bay holder - a minimum of one month’s notice will be given.

3. Customers must be able to reverse or use motor movers to site their caravan onto a storage bay

4. The customer will undertake to display a conventional ‘Ministry of Transport’ registration plate on the back of the caravan.

5. Poorly serviced and untidy looking units will not be accepted into storage. Caravans must be kept in good order and appearance; all caravans must be serviced and washed at least once a year.

6. There are no dedicated caravan washing facilities, however, with prior permission you can arrange to wash your caravan in a set washing area. We ask that the task is completed using water held in a bucket - no direct hose connection to a tap.

7. We ask that you do not display advertising material in your caravan - e.g. for sale signs

8. The caravan and its contents shall, at all times, be stored at the risk of the customer. Bow Hill Farm shall not be liable for any loss or damage to the caravan or contents however caused and shall be under no obligation to supervise the storage facility or to take any steps whatsoever to protect the caravan or the contents thereof against such loss or damage

9. All items stored at Bow Hill Farm must be insured by the owner prior to the commencement of storage and the insurance must be maintained throughout the term of storage. The insurer must be informed the caravan is in storage.

10. Hitch posts are provided for some storage bays. These are a theft deterrent device and we cannot guarantee that it will resist the efforts of a most determined thief and as such we do not accept any liability for the loss or damage caused by theft, vandalism or other illegal activity against property to which the device is fitted.

11. All caravans to be parked correctly within the allocated bay

12. Standard access to the site is between the hours of 9am and 5pm. Access at any other time by arrangement. Units may be returned or removed during the follow times - October to March 9am to dusk, April to September 9am to 8pm. We ask that you confirm by email your intention to remove/return you unit from/to storage. Ideally we would ask for 12 hours prior notification.

13. The storage facility is situated next to a Certificated Location and we ask that you respect the peace and tranquillity that this CL site provides the occupants

14. The storage area is secured by locked gates. The gates will be locked overnight. Gates will be locked by a padlock. Bow Hill Farm reserve the right to change this lock code without notice, but will inform all customers whose accounts are not in arrears of the new code. You are responsible to ensure the gate is locked upon your departure from the storage area.

15. A £50 deposit, refundable upon return of key/lock in full working order, is required for the hitch post key/lock. The full cost to replace any lost key/lock or damaged key/lock will be charged to the storage customer.

16. No under 16’s allowed on site. No visitors are allowed on site at any time

17. For both your safety and that of others the site speed limit is 5mph. Please do not obstruct the roadways, building entrances or gateways

18. The storage site is not a car park facility. You may only park you car on site whilst attending your caravan held in storage.

19. Dogs to be kept on a lead at all times. No other pets/animals allowed on site.

20. No litter to be left on site. All rubbish/waste to be immediately removed from the site - no waste bin/collection is provided on site. No additional items to be stored, the storage bay is provided for the storage of your caravan only.

21. You may use the chemical disposal point prior to returning your caravan to storage

22. Shower facilities are strictly for use by customers currently booked onto a pitch on the Certificated Location

23. If you change your car registration, address, telephone number or email then please inform us by email philip@bhfcaravanstorage.co.uk with the correct details

24. Please note that overnight sleeping at the storage facility is not allowed under any circumstances.

25. During the winter months, or whenever the ground is likely to be soft, only drive on marked roadways. You must avoid causing unnecessary damage to the grass. The charge for damage to a pitch is £75.00.

26. To assist with the efficient management of the site, we reserve the right, after notification to the parties concerned, to ask for the relocation of the caravan to be undertaken to a more appropriate storage bay.

27. Caravan alarms must cease sounding after 2 minutes. If your caravan has an active alarm installed then you must provide a code/key to deactivate this alarm (by providing this you confirm that Bow Hill Farm have the authority to enter your caravan to access the alarm). If an alarm has more than one false activation then we will ask you to service or deactivate the alarm to avoid further false activations. We will inform you during normal office hours, of an alarm activation.

28. Service or repairs to your caravan is not permitted on site without written prior arrangement. We do not supply facilities for service works to be undertaken on site. No major repairs to be carried out on site (minor repairs can be undertaken with permission from Bow Hill Farm)

29. To protect customers caravans Bow Hill Farm reserve the right to close access to the storage site when bad weather has made driving conditions hazardous.

30. Wherever possible all gas bottles are to be removed from the caravan, and no other toxic, dangerous, hazardous or explosive goods are permitted on site. In the event the gas bottles cannot be removed they must be switched off. Batteries must be disconnected before going into storage

31. Any storage customer’s caravan being sold to a third party may not automatically be accepted back into storage.

32. Bow Hill Farm may wish to assess the age and condition of the caravan before making a decision to provide storage. Any caravan reaching 15 years of age from new will be assessed for its suitability for continued occupation of the storage facility. Bow Hill Farm’s decision will be final.

33. The Storage Agreement may be terminated:

a) by Bow Hill Farm if this agreement is not adhered to by the customer.

b) by the customer removing the caravan from Bow Hill Farm following payment of all fees due.

c) either party may terminate the Agreement as outlined in point a and b above. If the Agreement is terminated during a period in which the storage fee has been paid in advance Bow Hill Farm shall not make any refund to the customer.

d) Bow Hill Farm reserve the right to refuse a customer requiring storage for a caravan or to terminate this storage agreement without explanation

34. In the event of the storage fee being overdue Bow Hill Farm may retain possession (lien) until the arrears are settled in full or otherwise discharged. Bow Hill Farm retain the rights to sell, remove or dispose of the caravan via The Torts Interference with Goods Act 1977 if after 3 months (90 days) from the initial payment date or renewal date no payment has been received. Upon giving the customer 28 days notice of intention to do so at the last held address and contact details, the caravan will be offered for sale and Bow Hill Farm will deduct the following:

a) any costs of sale including but not limited to, costs incurred in advertising, a reasonable sum in respect of time spent in arranging the sale, any servicing costs and commission

b) payable to an agent instructed to sell the caravan on Bow Hill Farm’s behalf and any legal costs incurred.

c) any sum due from the customer to Bow Hill Farm for storage under this Agreement.

35. Where the caravan owner terminates the contract prior to the agreed period of 12 months, Bow Hill Farm will be entitled to charge for reasonable administration costs resulting from the termination, and for the loss of storage fees until the plot is re-let. A surcharge of £10.00 per month on the outstanding fees will be charged.

36. Bow Hill Farm excludes all liability caused by Vermin Infestation, a vermin control regime is in place and is monitored regularly. Owners must remove food sources from caravans during storage periods

37. General Data Protection Regulation. Customers names and addresses will be stored on computer systems in relation to Bow Hill Farm’s business activities. When a storage contract is terminated by either party Bow Hill Farm will delete all information held in relation to that account unless the data is required for business regulations.

38. These terms and conditions shall be governed by and construed in accordance with English law and Bow Hill Farm and the customer agree to submit to the exclusive jurisdiction of the English courts in the event of any dispute between them, whether arising out of contract or otherwise.

39. If any provision of these terms and conditions is held by any court or other competent authority to be void or unenforceable in whole or in part, these terms and conditions shall continue to be valid as to the remaining provisions and the remainder of the affected provision provided that the invalidity or unenforceability of the provision shall not prevent or unduly hamper performance under these terms and conditions.

40. Bow Hill Farm shall not be liable for any consequential or indirect loss suffered by the customer, whether this loss arises from a breach of duty in contract or tort or in any other way (including loss arising from Bow Hill Farm’s negligence)

41. Bow Hill Farm shall not be in breach of its agreement with the customer if it fails to perform its obligations or delays its performance as a result of acts of God, industrial action, strike, lockouts, general or partial stoppage or restraint of labour from whatever cause, or any other event beyond the reasonable control of Bow Hill Farm
